The Employment Standards Act (ESA) uses to staff members.

A worker includes an individual who:

- carries out work for an employer for wages
- supplies services to a company for salaries
- gets training from an employer, if the ability in which the person is being trained is an ability used by the employer's employees
- is a homeworker
- was a staff member
Effective March 21, 2024, a worker consists of a person who performs work during a trial period for an employer, if the abilities being evaluated throughout the trial duration are abilities utilized by the company's workers or could be utilized by workers if there are no other workers. For instance, where a company of a restaurant asks a job candidate to work a trial shift waiting tables to show their capability to carry out the job, even where no work deal has actually been made to that prospect, the person is a staff member under the ESA.

The ESA does not use to independent professionals, volunteers or other individuals who are not covered under the ESA. A specific thought about a worker may be entitled to rights such as:

- base pay
- overtime pay
- public vacations
- holiday with pay
- notification of termination or termination pay
Under the ESA, employers are not enabled to treat workers covered by the Act as if they are not workers. If a company misclassifies a staff member in this method, an employment standards officer can provide a notice of contravention that leads to a charge, a prosecution or both against the company.

Please note, the ESA provides minimum standards only. Some staff members may have higher rights under an employment agreement, collective contract, the common law or other legislation.

How to tell who is a staff member

How to tell who is an independent professional

An independent specialist is somebody who is in organization for themselves. A person might be considered an independent professional, and not covered by the ESA, when at least some of the following uses:

- determines how, when or where the work is performed

Example

Fariah works as a customer support agent for a sales business. She should work Monday to Friday from 9:00 a.m. to 5:00 p.m. in the organization's workplace. She utilizes the company's telephones and computers. She is paid $25.50 per hour. Her work contract does not have an end date, although her employer can fire or discipline her for bad efficiency. Her employment agreement specifies that she is an independent specialist and so she does not receive overtime pay, holiday pay or public holiday pay.

It does not matter that Fariah signed the employment agreement stating that she is an independent contractor because the realities reveal she is an employee.

Employee or independent professional: Common misunderstandings

A person might be considered a worker even if:

- the individual and the service concur (orally or in writing) that the person is an independent professional. It is the relationship between the individual and the company (or person) that matters, not the label that is provided to it
- the individual:- charges the balanced sales tax (HST).
- sends invoices to the service.
- utilizes their own lorry for work functions.


Volunteers

Volunteers are not staff members under the ESA. However, the reality that someone is called a "volunteer" does not identify whether that person is an employee and entitled to the defenses of the ESA.

The primary factors that identify whether somebody is a volunteer or a worker are how much:

- business (or wiki.asexuality.org individual) take advantage of the individual's services.
- the private views the arrangement as being in pursuit of a living.
In family-run organizations, the question will typically be whether the person is providing services in pursuit of a living or in service of the family.

If the individual is supplying services to the household, rather than services in pursuit of a living, that person is more likely to be a volunteer.

The truth that no salaries were paid does not necessarily imply that someone is a volunteer. The truth that there was some kind of payment does not necessarily indicate someone is a worker. For example, an honorarium might have been paid, instead of incomes.
